Who you are contracting with

The Call Recorder Tapecall ACR iOS app, the recording service it connects to, and the gcr.fibomobile.com website (together, the "Service") are provided by the company identified below.

Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse engineer, decompile, rent, lease, sell or redistribute the app or any part of it, except where that restriction is prohibited by law.

Your responsibility when recording — read this one

The law on recording telephone conversations differs sharply between countries and, in the United States, between states. In many jurisdictions a call may be recorded only if every participant knows and agrees. In others — including Türkiye — recording a private conversation without the other party\'s consent, or disclosing its content, can be a criminal offence carrying a prison sentence.

• Before you record, tell every participant that the call is being recorded and obtain their agreement.
• If you are unsure whether recording is lawful in your situation, do not record.
• Sharing a recording can carry separate and sometimes greater liability than making it. Treat every recording as confidential.
• Recording a conversation you are not part of is unlawful almost everywhere.

You are solely responsible for complying with the law that applies to you and to the people you call. We provide a tool; how you use it is your decision and your responsibility. We do not verify consent and we have no way to.

If you use the Service unlawfully, we may suspend or end your access, and we will comply with lawful orders from competent authorities.

How the Service works, and what it requires

iOS does not allow an app to record the audio of a normal phone call. This app records by placing a second call to our recording line and merging it into your conversation, the way a three-way call works. The recording is created and stored on our servers, not on your device. The Privacy Policy describes what that means for your data.

The Service therefore depends on your network operator supporting conference calling. Where it does not, the app cannot record, and that is a limitation of the telephone network rather than a defect in the Service. Call charges, if any, are a matter between you and your operator.

Subscriptions, renewal and cancellation

The app is free to download. Premium is offered as an auto-renewing subscription through your Apple ID. The plans currently offered are:

Prices are shown in US dollars; you are charged in your local currency at the price shown in the App Store for your storefront, which may differ because of local taxes and currency conversion.

Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends.

You can manage or cancel the subscription in your App Store account settings: open Settings, tap your name, tap Subscriptions and select Call Recorder. Deleting the app does not cancel the subscription.

Where a free trial is offered, any unused portion of it is forfeited when you purchase a subscription for that product.

Refunds

Purchases are made from Apple and refunds are issued by Apple under its own policy. We cannot issue a refund for an App Store purchase. Request one at reportaproblem.apple.com.

Your recordings

Your recordings are yours. We do not claim ownership of them, we do not listen to them, and we do not use them for any purpose other than delivering the Service to you.

You are responsible for what you record and for what you do with it afterwards. Deleting a recording in the app deletes it from our servers. Keep your own copy of anything you need to retain, because we do not undertake to store recordings indefinitely and we may end the Service.

Acceptable use

• Do not use the Service to record anyone without the agreement the law requires.
• Do not use the Service unlawfully, or to help anyone else do so.
• Do not attempt to gain unauthorised access to the Service, to our recording line, or to any recording that is not yours.
• Do not interfere with the operation of the Service or with other users\' use of it.

Intellectual property

The app, the website, their design, code, text and graphics are owned by us or our licensors and are protected by copyright and other laws. These terms give you a licence to use the app, not ownership of it. Apple, iPhone, iOS and App Store are trademarks of Apple Inc.

Termination

You may stop using the app at any time by deleting it and cancelling any subscription. We may suspend or end your licence if you materially breach these terms, in particular the recording responsibilities in section 3. Termination does not entitle you to a refund of any amount already charged by Apple, and the provisions on disclaimers, liability and governing law survive it.

Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that a recording will succeed, that audio quality will be adequate, or that the Service will be uninterrupted or error-free — recording depends on your network, your operator and conditions outside our control. Nothing here excludes any statutory right you have as a consumer that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or in connection with your use of or inability to use the Service. This includes a recording that failed, a recording that was lost, and any consequence of your use of a recording — including any legal proceeding, penalty or claim arising from recording or sharing a conversation.

Where liability cannot be excluded, our total liability to you for all claims relating to the Service is limited to the greater of the amount you paid for the Service in the twelve months before the claim arose, or ten US dollars.

Apple-specific terms

This section applies to the app obtained through the App Store and takes precedence over anything inconsistent elsewhere in these terms.

• These terms are between you and us only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to furnish any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection legislation.
• Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right to enforce them against you.

Governing law

These terms are governed by the laws of the Republic of Türkiye, and the courts and execution offices of İstanbul (Çağlayan) have jurisdiction. If you are a consumer resident in the European Union, the United Kingdom or another country whose law gives you the protection of its mandatory consumer rules and the jurisdiction of its own courts, nothing here deprives you of that protection.

Changes and contact

We may update these terms. The current version always lives at this address with its date at the top. Continuing to use the app after a change means you accept the updated terms; if you do not accept them, stop using the app and cancel any subscription.
